Background - Chicago Cubs Rooftop
The 20-year agreement, which could take effect this season, calls for the owners of 11 buildings to give the Cubs 17 percent of their gross revenue, said Alderman Thomas Tunney. With an estimated 1,700 seats on the rooftops, it could cost owners more than $2 million a year.
The Cubs had been arguing with the rooftop owners over plans to expand the stadium without obstructing the view from the rooftops. After negotiations broke down, the Cubs sued the owners in December 2002. The lawsuit accused the owners of stealing the team's product, copyright infringement and unjust enrichment at the Cubs' expense.
There's a settlement between the Chicago Cubs and most of the owners of the rooftop bleachers that overlook Wrigley Field. The Cubs have argued with rooftop owners over plans to expand the stadium without obstructing those rooftop views, and the team has filed a lawsuit.
Officials say owners of eleven of the 13 buildings have reached an agreement that would require the owners to pay the team 17 percent of their gross revenue. That could be about two million dollars a year. Owners for two of the buildings have not agreed and plan to take the issue to trial.
Brixen Ivy was the first building erected from the ground up to be a Wrigley Field Rooftop facility. The 'little yellow framed house' at 1044 Waveland was purchased from the Nitahara family in 1998. The house was torn down immediately after Sammy Sosa's record breaking season and officially began entertaining rooftop customers in the 2000 season.

Just recently most of the rooftops, including Brixen Ivy have agreed to pay the Chicago Cubs 17% of total revenues. The Chicago Cubs Baseball League have agreed to endorse those rooftops that are providing revenue to their organization.
